A trilateral view on patents after grant and what strength can mean:
A judge, a lawyer and a patent attorney will discuss their different aspects in evaluating the strength of patents for enforcement, vulnerability of patents and defense against patents in a system of bifurcation. The trialogue discussion will touch upon subjects like thoughts about content, number and categories of granted claims in post-grant proceedings, protection for fundamental or incremental inventions, the consequences of amendments in the description in later proceedings, nullity actions and suspension of infringement proceedings, defensive or proactive strategies against preliminary actions.
Dr Peter Kather (Lawyer)
